GENERAL TERMS OF SALE

These terms define the procedure for ordering, payment, delivery, and complaints of products offered on our website. The seller of the products is Angara Ltd., Kasinski odvojak 20a, 10360 Sesvete, OIB 95745406877, registered with the Commercial Court in Zagreb under registration number MBS 080797593 - Share capital 20,000.00 kuna / 2,654.46 euros (fixed conversion rate 7.53450), represented by director Ivan Franjić, and the buyer of the products is a visitor of the online store who selects at least one product, fills out the electronic order form, and sends it to the seller.

After the order is made and confirmed, you will receive an email confirmation that the order has been received by Mala od Lavande. The confirmation is automatically generated by the server and sent to the customer at the time of order confirmation.

If you do not receive such a message, please check:

1. If the message is in your Junk/Spam folder

2. If your mailbox is full

3. If the items are in your cart after logging in to the Mala od Lavande website, in which case repeat the ordering process.

1. PAYMENT

Product prices are expressed in Croatian kuna and euros.

The Buyer is obliged to make the payment within seven days from the selection of the product. Otherwise, the offer will be automatically canceled, and the Buyer will be notified to the email address provided during registration.

In case the Buyer makes the payment on time but does not receive a notification to the email address provided during registration, the Buyer is obliged to inform the Seller within two days.

The buyer undertakes to pay for the ordered products with delivery costs by wire transfer or credit card. It is also possible to pay cash on delivery upon delivery to the courier service (for this courier service, a fee specified under point 2. Shipping and handling) will be charged.

You can pay for the ordered products in the following ways

1. Via general payment slip
2. Cash on delivery upon receipt of the product from the courier
3. Maestro, MasterCard, Visa, Visa Inspire, Diners, Premium Visa or Discover cards
4. Paypal
5. KEKSpay

If you have chosen to pay by wire transfer or general payment slip, a confirmation of your order will be sent to your email address. Employees of Male od lavande Internet store will contact you if necessary.

Upon receipt of payment, we will send you the ordered products. The ordered products are delivered to the buyer in accordance with the delivery terms.

2. Cash on delivery upon receipt of the product from the courier

Cash on delivery allows you to settle orders upon delivery to the specified address, or only when you see the product in front of you. Cash on delivery is not possible for personal pickup of goods at our warehouse. Cash on delivery is exclusively made in cash, to the delivery person upon delivery to the specified address. In case the recipient is unable to receive the shipment at the defined delivery address at the time of delivery, the delivery person leaves a notice of the arrival of the shipment.

In case of non-collection of the package with cash on delivery, an invoice for the cost of delivery will be issued later.

When paying on our webshop, use CorvusPay– an advanced system for secure acceptance of payment cards via the Internet.

The form for entering payment data is secured with SSL transport encryption of the highest reliability. All stored data is additionally protected by encryption, using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. CorvusPay meets all security requirements for online payments prescribed by leading card brands, and operates in accordance with the PCI DSS Level 1 standard - the highest security standard in the payment card industry. When paying with cards included in the 3-D Secure program, your bank verifies your identity in addition to the validity of the card itself using a token or password.

4. Paypal account

Paying with a Paypal account is the fastest and safest form of online payment.

The monetary obligation that the Buyer pays through the payment service provider shall be deemed settled on the day when the payment service provider received the payment order from the buyer and when that order became irrevocable in accordance with the provisions of the laws governing payment transactions.

When making a payment to a foreign currency account, the Buyer is obliged to cover all costs (including the costs of the sending and receiving bank) in which the funds are deposited (the amount is not shown on the offer because it depends on the bank).

The cost of delivery is additionally charged to the price according to the price list published on the Internet store's website.

The sales contract is concluded at the moment of receiving the payment.

2. SHIPPING AND DELIVERY

Delivery for all orders over 34 EUR purchased in the Mala od lavande online store is free for the entire area of Croatia.

Products purchased in the Online store are delivered by courier services. The order will be delivered to the address indicated by the Buyer during the purchase.

The delivery price is in accordance with the rules of courier services:

4€ for all types of payment except for cash on delivery where an additional fee of 0.70€ is charged on the basic postage price. Postage for orders over 34€ is free, except for cash on delivery where only a fee of 0.70€ is charged to the courier service for payment at the doorstep.

PICK & PACK d.o.o. - GLS - delivers in the territory of the Republic of Croatia

5€ for all types of payment except for cash on delivery where an additional fee of 0.70€ is charged on the basic postage price. Postage for orders over 34€ is free, except for cash on delivery where only a fee of 0.70€ is charged to the courier service for payment at the doorstep.

In case of non-collection of the package with cash on delivery, an invoice for the cost of delivery will be issued later.

PICK & PACK d.o.o. - international delivery

The process of packaging and shipping the products begins after the payment becomes visible on the bank statement of Angara d.o.o. and on the customer's page on malaodlavande.com respectively in order of arrival. PREPARATION OF PRODUCTS FOR SHIPPING CAN TAKE UP TO 7 WORKING DAYS!!!!

Courier services deliver the products to the address within the Republic of Croatia within three to five WORKING days.

If the Buyer does not pick up their shipment and it is returned to the Seller's address, the Buyer can:

(1) pay the postage again increased by ½ of the postage amount charged by the courier service to the Seller upon package return in order for the Seller to deliver the order again; or

(2) cancel the purchase, in which case the Seller will refund the paid amount reduced by the postage amount and ½ of the postage amount charged by the courier service to the Seller upon package return, as well as bank costs.

The ordered products are packed in such a way that they cannot be damaged by usual handling during transport. The Buyer is obliged to check for any damages when receiving the products and immediately report them to the delivery worker who delivered the products, and refuse to accept the delivered products with visible external damages.


3. RETURN / COMPLAINT OF PURCHASED PRODUCTS

The Buyer has the right to return the products in the following cases:

(1) delivery of products that were not ordered

(2) delivery of products that have expired

(3) delivery of products with defects or damage

Upon receipt of the product, the accuracy of the order depends on the Customer. Please compare the received products with the invoice, if something is missing, immediately notify your delivery person as we do not accept claims for compensation.

In case it is not possible to deliver another product, the Seller will compensate the Customer for the value of the product that can no longer be delivered.

If the Customer has a valid complaint about the delivered products, they are obliged to inform the Seller in writing and return the products in the condition in which they were delivered and in the original packaging, otherwise they lose the right to a refund.

The Seller will refund the funds or replace the product within thirty working days from the day of receiving the returned product according to the approved complaint.

In case of a refund, the Seller will only refund the amount paid for the purchased item to the Customer, not the additional costs (delivery, bank transfer fees, etc.) that have arisen from the purchase.


4. COMPLAINTS AND APPEALS

In accordance with Article 8, paragraph 2 of the Consumer Protection Act (Official Gazette, No. 79/07, 125/07 - correction, 79/09 and 89/09 - correction), we inform consumers that they can submit a complaint about the quality of our services in writing to the address:

We will provide a written response to your complaint no later than 15 days from the date of receipt of the complaint or via e-mail.


5. DEADLINE FOR FULFILLMENT

The Seller undertakes to fulfill the sales contract without delay, and no later than 30 days from the date of conclusion of the contract, with the process of production, packaging and delivery starting when all products within the order are available, and no later than ten working days from receipt of payment.

If the Seller is unable to fulfill the contract within this period, they will inform the Buyer in writing without delay, and the Buyer may grant the Seller an additional period for fulfillment of the contract, choose a substitute product, or declare the termination of the contract in writing.


6. RIGHT TO UNILATERAL TERMINATION OF CONTRACT

The buyer can unilaterally terminate the contract, without stating a reason, within 14 days from the day when the goods that are the subject of the contract are delivered to the buyer or to a third party designated by the buyer, who is not the carrier.

The buyer is obliged to inform the seller of his decision to terminate the contract before the expiration of the deadline for unilateral termination, either by using the form for unilateral termination of the contract or by any other unambiguous statement expressing his intention to terminate the contract.

The effect of unilateral termination of the contract

In case of contract termination, each party is obliged to return to the other party what it has received based on the contract.

The Seller will refund the Buyer only after the goods have been returned to him, or after the Buyer provides proof that the goods have been sent back to the Seller.

The Seller will refund the payment using the same means of payment that the Buyer used for payment, unless the Buyer expressly agrees to another means of payment, assuming that the Buyer will not be obliged to pay any additional costs for such refund.

The Buyer must return the goods without delay, and no later than within 14 days from the date when he informed the Seller of his decision to terminate the contract.

The Buyer shall bear only the direct costs of returning the goods and shall be responsible for any reduction in the value of the goods resulting from handling the goods, except for that which was necessary to determine the nature, characteristics, and functioning of the goods.

If the product is used, the Seller is not obliged to refund the paid amount. If the Buyer ordered a product that was ordered exclusively for him, there is no possibility of returning the product, except in the case of a product complaint.

In case the Buyer orders goods and refuses to accept them, the Seller has the right to request compensation for postal and own handling costs from the Buyer.

7. ISSUANCE OF R-1 INVOICE

R-1 invoice is issued and sent by courier service together with the products. The Buyer is obliged to enter the necessary information when ordering.


8. LIABILITY FOR MATERIAL DEFECTS

Material defects of the product will be resolved by the parties in accordance with the Obligations Act.

9. PRODUCT VALIDITY PERIOD AND USE

All products on the Seller's website are natural and the expiration date of all products is stated on the product label.

The Seller is not responsible for any skin reactions that may occur from using the product because they do not have insight into the individual health conditions of the buyers.

All ingredients used in our products are listed on our website, as well as their indications and contraindications, and if the Buyer is unsure about the use of certain oils and preparations, it is necessary to consult a doctor.

Information about essential oils on the Seller's website is provided solely for informational purposes and does not include all necessary precautions or their mode of action, possible interactions with other oils, and the consequences of their use. The purpose of this information is not to provide medical advice, prescribe therapy, diagnose, or provide instructions on the use of individual products.

The Seller assumes no responsibility for the use of information published on the Internet store's pages.

10. STATEMENT ON PROTECTION AND COLLECTION OF PERSONAL DATA AND THEIR USE

Privacy protection describes how the Seller handles your personal data received during the use of the Internet store. Your identification data are considered personal data: name and surname, e-mail address, home address and telephone number, or data that are not otherwise publicly available and that the Seller learns during your use of the Internet store.

The Seller will keep your personal data confidential and will not distribute, disclose, provide third parties with the use of them or otherwise make them available to any third party without your prior consent. You can read more about the security of your data in "Data security" that we have improved and aligned with the conditions set by the European Commission for the implementation of GDPR regulation (General Data Protection Regulation).


11. AMENDMENTS

The Seller reserves the right to change these terms and rules, and excludes its liability for possible consequences of such changes and undertakes to inform all registered users via the e-mail addresses they entered during registration.


12. REGISTRATION

The buyer is responsible for the accuracy and completeness of the entered data during registration. If there are any changes to the data you entered during registration, you are obliged to immediately update your user account to inform us of the changes that have occurred.

13. LOYALTY POINTS


On the website malaodlavande.com, it is possible to collect loyalty points with each purchase.

Details:

1. The value of 1 reward point is 1€.

2. Points are valid for 90 days from the moment you win them.

3. After 90 days, if you have not used the points, the system cancels them and they are no longer active and cannot be converted into a coupon.

4. Only registered users participate in the reward program and earn reward points.

5. The minimum amount of the shopping cart in order to earn points with each order must be higher than 15€.

6. Each registered buyer earns 5% of the value of that order back in the form of loyalty points that can be used for the next purchase.

7. When you recommend our natural cosmetics to a new customer who registers on our website, both you and the new customer will receive 1 point equivalent to 1€.

8. From every order of a new customer you recommended, you will receive 2.5% of the value of their order in the form of points that you can collect and use as a discount on your next purchase.

9. Points are not transferable to other user accounts, they are tied to the email address used for registration.

14. SPIN & WIN game of chance

The wheel of fortune allows the user to win one of the daily discounts. The discount code is displayed on the website and sent to the email provided during the game. The code can only be used by a user who is registered on the malaodlavande.com webshop with the same email used for the game. If the user is not registered, they can register and use the received code.

The system will not recognize the code if the user is not logged in with the email address to which the code was sent at the time of entering the code.

The discount code is non-transferable and can only be used by the user who received it.


15. PRODUCT PRICES

15.1 All product prices are retail prices. Product prices and delivery prices are expressed in Euros and Croatian Kuna and include the corresponding VAT.

15.2 The process of entering prices on the website for each product is subject to multiple levels of control, but regardless of that, there is a possibility of error occurring, as it is not an automatic entry. Such situations are exceptional, and the Seller apologizes in advance to its customers because they will be forced to inform them about the situation that has arisen, the wrong price for a particular product, and the impossibility of delivery according to the specific customer order.

15.3 The Seller is authorized to change prices without prior notice, as well as to change prices exclusively for Online purchases without prior notice.

15.4 The Seller is authorized to determine sales, daily or weekly promotional sales for individual Products, a group of Products, and/or for all Products at any time.

15.5 Prices, payment terms and promotional offers are valid only at the time of ordering. During a promotional sale, please note that the sale of discounted products is limited. Customers may be provided with a limited quantity of products, sufficient for household use.
